5. Bielefelder Verfahrenstage: Wider die wildwüchsige Entwicklung des Ermittlungsverfahrens

The historical conception of the code of criminal procedure intended the main hearing (in which guilt or innocence of the accused is decided) to be the centerpiece of the criminal procedure. Although, for quite some time now, the preliminary proceedings are gaining importance: This early stadium of a criminal procedure already sets the course for the result of the lawsuit. During the last decades, the reality of the preliminary proceedings has gone through considerable change, driven by several initiators: On the one hand, legislative reforms were introduced, reacting to legal developments (Europeanization of law as well as impacts of the constitutional dispensation of justice on criminal case law). On the other hand, "pressure-groups" (different stakeholders and practitioners) influenced the preliminary proceedings. These modifications, however, were neither coordinated nor respecting the whole legal context, but rather selective and without sound relation.

The ZiF Workshop has taken an interdisciplinary inventory of these uncoordinated developments and analyzed their consequences for the architecture of the criminal procedure. According to the workshop's concept, speakers from justice, advocacy, police practice and politics, as well as from scientific fields such as law, sociology of law, criminology, political and communication science and neurophilosophy added to the wide discourse.

The concluding panel discussion pointed out the actuality of this topic. Besides others, two members of an expert commission, which was recently installed by the German Federal Minister of Justice to reform the criminal procedure, took part in the discussion. Although the participants didn't agree on necessity and content of future changes, it became clear that there is an uncontrolled growth in development, implying a need for rational legal policy.
