1. Terms of use for the crisis and emergency app EVALARM at University Bielefeld
University Bielefeld provdes the crisis and emergency app EVALARM (hereinafter referred to as "App") to all members of the University, University members and guests of University Bielefeld with the warning messages, emergency call functions and information services offered on the basis of the following terms of use.
Before using the app for the first time, the user must obtain sufficient information about the range of functions and is responsible for its proper use. By using the APP and giving your consent, you recognise the terms of use.
2. Purpose of the app
(1) The app provides warning messages, instructions for action and information on dangerous situations on the campus of Bielefeld University.
(2) The app uses the emergency call/SOS function to establish a direct connection with University's Bielefeld Central Control Room (0521-106-112) in the event of an emergency.
(3) The app is an extension of the existing alarm options at University Bielefeld (e.g. acoustic fire alarm system, voice alarm).
(4) The app is part of University's Bielefeld crisis management system, with which University Bielefeld has prepared itself for various hazardous situations.
(3) General conditions for using the app
Hazardous situations are often confusing, complex and can change very quickly. Using the app therefore does not absolve you from paying attention to other communication channels, such as acoustic alarms, loudspeaker announcements or information from the emergency services on site. In case of doubt, the instructions on site take precedence over the warning message of the app and the instructions on site must be followed.

5. Free provision of the app
The app is provided free of charge by the university. An internet connection is required to receive current alerts. For full functionality, an end device that can carry out location analyses is required.
6. Registration of users via the guest role (university members/members, guests)
All university members and guests of the university can register independently via the user role "guest" on the platform app. Use of the app is voluntary and subject to the user's consent.
The following data is required:
When registering, the user of the app (guest) must agree to the terms of use and take note of the data protection information. Only after confirmation will the user receive the access data sent to the email address provided. All stored personal data is listed in the registration email. With the access data, the user can log into the app and actively use the service.
The administrators of University Bielefeld can see which user has registered with the corresponding "Guest" role. The administrators can view the user's personal details. The terms of use of the crisis and emergency app can be accessed in the app at any time.
7. Registration of functionaries within crisis management (crisis team, intervention team, etc.)
The registration of functionaries (e.g. crisis team members, intervention team) is initially carried out in the same way as the registration process for guests. The assignment to the respective roles is then carried out by the administrators.
8. Access to personal data when raising the alarm
When an alarm is raised, personal data is made available to the recipients of the alarm. Recipients of an alarm can see who triggered, changed or cancelled the alarm. The profile data (name, first name, telephone number, email address) of the user is displayed to the recipient. This data can be viewed by users with the user roles administrator, emergency and crisis team leader, emergency and crisis team member and employee.
Users with the "Guest" user role (e.g. students) do not see any personal data. Only alarm details for an alarm process in which the users are explicitly integrated can be called up.
All alarm details are logged. In addition to the personal master data, this also includes the delivery log for all authorised function holders, read confirmation, acceptance and rejection of alarms, alarm triggering and alarm updating.
In addition, the GPS coordinates are transmitted when the SOS alarm is triggered.
9. Archiving and deletion of alarm data
All archiving data is automatically archived after an alarm has ended. Users with the "Guest" role do not have access to archived alarms. The Administrator, Crisis Team Leader, Crisis Team Members and Employees user roles have access to archived alarms on the mobile client (app) for 7 days.
The alarms can be accessed in the web interface for 3 months. Approval on the web interface is only possible for the role of administrator, crisis team leader, crisis team members and employees.
Archived alarms are automatically deleted after 3 months.
Contact lists are also transferred in the event of an alarm. The contact lists are no longer displayed on the mobile client (app) when an alarm is cancelled. Contact lists can be made available to individual users on an alarm-related basis.
10. Logging out and deleting the account for all users
All users of the crisis and emergency app can log out in the app at any time. They can also delete their own account in the app at any time.
After deleting the account in the app, the user will receive a confirmation message to the email address provided to permanently delete their account. The link is valid for 24 hours and must be activated for deletion during this period. The app service can then no longer be used.
When the account is deleted, the data, including the data from the alerting processes, is anonymised and permanently deleted after 90 days.
The administrators of University Bielefeld will no longer have access to the user's personal data once the account has been deactivated.
In cases of suspicion (criminal relevance, e.g. misuse of emergency numbers), the anonymised data can be restored by GroupKom GmbH as the provider of the EVALARM App cloud solution within the 90-day time frame.
11 Responsibility for the content and its availability
(1) Content
The information provided on the University's crisis and emergency organisation has been compiled and carefully checked by experts. The University endeavours to ensure that the information provided is up-to-date, correct and complete. The app only contains a selection of the information published by the AGUS staff unit. Alerts in the event of dangerous situations are initiated by the crisis team and entered into the app.
(2) Availability of information/technical breakdowns
Due to the dependence on mobile phone networks and data connection quality on the campus of University Bielefeld, technical impairments, e.g. delayed notification by push message or failure of the availability of the service for the user cannot be ruled out. The same applies to breakdowns, interruptions or a possible failure in the provision of information. University Bielefeld cannot guarantee permanent and uninterrupted availability.
12. Dissemination of content and copyright
(1) The alerts and information provided in the app can be disseminated to university members as long as the content is not changed. To this end, University Bielefeld grants a non-exclusive and non-transferable right to use the alerts and information provided in a non-commercial manner.
(2) University Bielefeld respects the copyrights of the company GroupKom for the EVALARM service. All rights to the app and/or those acting on behalf of GroupKom and companies affiliated with GroupKom are and remain the sole property of GroupKom and its licensors. The mobile app for the EVALARM® service is made available to University Bielefeld under a General Usage and Licence Agreement. The app and the EVALARM service are offered and operated by GroupKom GmbH, Behringstraße 21- 25, 12437 Berlin (info@evalarm.de).
13. data protection
University Bielefeld undertakes to comply with data protection regulations. Details can be found in the data protection declaration.
14. third-party services and content
In the context of using the EVALARM service, offers and content from third-party providers with a legitimate interest pursuant to Art. 6 para. 1 f GDPR are used. This may result in the transfer of data to third countries. Agreements are concluded with the service providers for processing in accordance with the standard data protection clauses pursuant to Art. 46 para. 2 lit. c and d GDPR are completed.
Downloading the EVALARM app via the App Store
By downloading the EVALARM app, relevant information is transferred to the App Store of Google (Play Store) or Apple (App Store). The information includes user name, email address and account number. The data is collected directly by the provider, possibly in a third country. The data is not processed by GroupKom.
Use of reCAPTCHA for registration
ReCAPTCHA is a security service from Google that protects customer accounts from misuse by non-human login attempts. In doing so, reCAPTCHA collects data from users to determine whether the login action was initiated by a human. Among other things, the IP address and other data such as cookies, referrer URL or information about the browser and operating system are checked by Google, whereby the data may be processed outside the EU. However, the IP address will be shortened by Google beforehand within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Integration of external map material
Map material is integrated via Google Maps APIs and Apple Maps APIs to display GPS positions during alerting and configuration of EVALARM. In order for the map to be displayed, the IP address and location are transmitted to Google Maps or Apple Maps, whereby the data may be processed outside the EU. However, the IP address will be shortened by Google beforehand within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. 15. Cookies
The EVALARM service uses cookies. Cookies are text files that are placed and stored on a computer system via an Internet browser. Cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters that can be used to assign websites and servers to the specific internet browser in which the cookie was stored. This enables the websites and servers visited to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognised and identified via the unique cookie ID.
Through the use of cookies, the GroupKom GmbH can provide the users of EVALARM with more user-friendly services that would not be possible without the cookie setting. The data subject may, at any time, prevent the setting of cookies through the EVALARM service by means of a corresponding setting of the Internet browser used, and may thus permanently deny the setting of cookies.
If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of the EVALARM service may be fully usable. The legal basis for data processing is consent in accordance with. Art. 6 para. 1 f GDPR.

16. Changes to the terms of use
University Bielefeld reserves the right to update these terms of use from time to time, e.g. to adapt them to the latest state of technology. Users will be informed of any changes via the University's website https://www.uni-bielefeld.de/themen/hilfe-notfall/evalarm/. Use of the app is governed by the currently valid version of the Terms of Use. If the app continues to be used after the changes come into force, the user thereby declares their consent to the amended terms of use.
17. Misuse of emergency numbers
According to Section 145 (1) of the German Criminal Code, the misuse of emergency numbers is a punishable offence in Germany (Section 145 (1) of the German Criminal Code Anyone who intentionally or knowingly 1. misuses emergency numbers or emergency signals or 2. pretends that the support of others is required due to an accident or due to common danger or need is liable to a custodial sentence not exceeding one year or a monetary penalty).
Emergency signals and emergency numbers are brief acoustic or visual signals that indicate the existence of an emergency situation. This includes the SOS function and the emergency number function of the university's crisis app. The misuse of an emergency number or an emergency signal is given if it is not used as intended, i.e. inappropriately.
Therefore, any recognisable (but not necessarily actually perceived by others) activation of the emergency numbers and emergency signals that is not due to an emergency situation constitutes misuse.
Activating the emergency call functions via the crisis app without necessity (sending a so-called malicious alarm) is therefore misuse of an emergency number and therefore falls under Section 145 (1) of the German Criminal Code.
